These Terms are an agreement between you and Daniel Roca, an individual developer ("we", "us"; the operating company will replace this once it is formed), for the Saam app and website (the "Service"). By creating an account or using the Service you accept these Terms. Our Privacy Policy explains how we handle your data. If you downloaded Saam from Apple's App Store, these Terms replace Apple's standard licence agreement, and section 13 also applies.
1. Who can use Saam
You must be at least 16 years old.
If you are under the age of majority where you live, a parent or guardian must agree to these Terms and approve any purchase.
Keep your sign-in details safe. You are responsible for activity on your account. Tell us at hola@saamfluent.com if you think someone else has accessed it.
An account is for one person.
2. The Service
Saam teaches Thai, English and Spanish in any direction between them. It includes guided lessons, reviews, progress tracking and imports, and, depending on your plan, an AI tutor by text and voice and image scanning. Some features need an internet connection; core lessons also work offline.
Features, content and limits may change. We will give reasonable notice before removing a paid feature you use. We do not promise uninterrupted or error-free service.
3. AI tutor and AI content
The tutor is an AI, not a person. Voice and text conversations, corrections, explanations and image scans are produced by AI models provided by OpenAI.
AI output can be wrong, incomplete or unnatural, including pronunciation feedback, translations and tone guidance. Check important language (for example medical, legal, travel-safety or business matters) with a reliable human source.
Your progress is calculated by our own learning rules, but those rules depend on your answers and on AI observations, so estimates of your level are approximate.
We do not guarantee any learning outcome, level, exam result or fluency.
Saam is not a translation, interpreting or professional advice service.
4. Plans, subscriptions and purchases
Free. Some features are free and may have usage limits.
Saam Plus is an auto-renewing subscription, offered monthly or yearly, sometimes with a free trial. We may also offer higher tiers, such as Saam Pro, and consumable in-app purchases, such as packs of conversation minutes. The features, limits, prices and trial terms are shown in the app and in the store before you buy.
Billing by Apple or Google. All purchases are made through the App Store or Google Play and are subject to their terms. We never receive your card details.
Auto-renewal: subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends. Manage or cancel in your App Store or Google Play account settings.
Free trials: if you do not cancel at least 24 hours before the trial ends, the paid subscription starts and you are charged. Any unused part of a trial ends when you buy a subscription, where the store's rules provide for this.
Price changes: the stores notify you of price changes and, where required, ask for your consent.
Consumables: purchased minutes or similar credits do not expire while your account exists. They are used after any allowance included in your plan, have no cash value, cannot be transferred, and are lost if you delete your account.
Fair use: paid features have limits (for example daily or monthly voice minutes and scans) shown in the app. We may pause AI features temporarily to prevent abuse or during provider outages.
Refunds: refunds are handled by Apple or Google under their policies; we cannot issue them directly. If you are a consumer in the EU or UK and the store's process gives you a right of withdrawal, you exercise it with the store. By starting to use a purchase immediately, you agree that digital content is supplied straight away, which may end that right where the law allows. If a purchase is refunded, unused minutes or credits are removed.
Restoring purchases: use "Restore purchases" in the app while signed in to the same account.
Deleting your account does not cancel a subscription. Cancel it in your store settings.
5. Your content
"Your content" means word lists you import, photos you scan, text you type and what you say in voice lessons. You keep any rights you have in it. You give us a non-exclusive, worldwide, royalty-free licence to host, process and transmit your content only to provide and secure the Service for you, including sending it to our AI provider as described in the Privacy Policy. This licence ends when your content is deleted.
You confirm that you have the right to use your content and that it does not include other people's personal data without permission or anything unlawful.
6. Acceptable use
Do not:
break the law or infringe anyone's rights;
harass, threaten or abuse anyone, or use the AI tutor to create illegal, sexual, hateful or violent content;
try to bypass usage limits, payments, security or access controls, or access other users' data;
try to make the AI reveal its instructions, or misuse it for purposes unrelated to language learning;
copy, scrape or resell the Service or its course content, or use it to build a competing product or train AI models;
reverse engineer the app, except where the law allows it despite this restriction;
disrupt the Service with automated access, excessive requests or malicious code;
upload images of other people or of private documents without their permission.
7. Our content and licence
The app, course content, audio, design and the Saam name belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial learning, on devices you own or control, under these Terms and the rules of the store you downloaded it from. Feedback you send us may be used without obligation to you.
8. Third-party services
Saam relies on services such as Apple, Google, OpenAI, Supabase and RevenueCat, whose own terms may apply to you. We are not responsible for third-party services we do not control.
9. Suspension and termination
You can stop using Saam at any time and delete your account in Profile → Privacy & data. We may suspend or close your account, or limit features, if you seriously or repeatedly breach these Terms, if required by law, or to protect users or the Service. Where reasonable, we will tell you why and give you a chance to respond. If we close the Service entirely, we will give at least 30 days' notice where possible. Sections that by their nature should survive termination will survive.
10. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties such as merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights you have as a consumer under the law of the country where you live that cannot be excluded by contract.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, loss of profits or data, or for losses caused by AI output you relied on without checking, events outside our reasonable control, or third-party services. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 euros.
Nothing limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited by law.
12. Governing law and disputes
Until Saam’s operating company is formed and named here, these Terms are governed by the mandatory consumer law of the country where you live, and you may bring proceedings there. Please contact us first; most issues can be solved quickly.
13. Additional terms for Apple devices
If you downloaded Saam from the Apple App Store:
These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
Your licence is limited to using the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
We are solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our responsibility.
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms when using the app, such as your wireless data service agreement.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14. Changes to these Terms
We may update these Terms when the Service or the law changes. We will show the new date above and, for material changes, tell you in the app at least 30 days before they take effect, unless the change is legally required sooner. If you do not agree, you can stop using Saam and cancel your subscription before the change takes effect.
15. General
If any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. We may transfer these Terms to a successor of the Service without reducing your rights.
